It makes no sense in a state like Texas, where not even hardened criminals with a lengthy police record, often including even homicides, and who neither in prison or out show any desire to rehabilitatte themselves, usually serve even half of the 16 years actual prison time Gelabert has served already, to keep in prison a first offender, with no prior record of any kind, and who would be an extremely unlikely recidivist. We ask that you consider these mitigating factors and, as Texas law authorizes you to exercise clemency and/or recommend it to the Board of Pardons and Paroles, that you take the steps needed to commute Gelabert's sentence to time served.
